To the Chief Executive of Richmond Churches Housing Trust, and whosoever tit may concern.

 

Dear Mr. John Wood,

 

 What please is your disposition towards the message below from Mr. Esom?  Does he tell the truth? If so you stand responsible for a disreputable state of affairs. We are not happy.

 

 According to contractors on your development site, hence a letter to local residents from your Mr Lawrence Huntingford, trees are removed because of land contamination, albeit that our council's tree officer has since said that he had expected the same trees to be preserved. The foreman of the site has also insisted, even to a policeman (TW556) called to the scene of the crime, that permission was granted to fell the trees now lost. None of your people confessed to us at any stage to the existence a planning condition to protect the trees, nor did they say anything at all about a safety issue, the alleged result of their own malfeasance.

 

Is there then a good reason not to refer this to the police for further investigation?

I refer to your email on the above subject

 

For the avoidance of doubt, I should first make it clear that the damage to

the trees on this site necessitating their removal was not sanctioned by the

Council or officers and neither I nor other officers condone or defend what

the contractors have done in this respect.

The officer's advice to remove the trees in the interests of public safety

having seen that they were unstable due to the  contaminated earth removal

works, was based on a common sense assessment of the situation presented to

them as previously explained. The advice was not given as a formal decision

to vary or waive a planning condition but as a response to a situation that

had already taken place without approval from them or the local planning

authority. The formal procedures of considering any variations or waiving of

the conditions attached to the permission for the development have yet to

take place. When they do they will be subject to the normal and proper

planning control processes and the views of interested parties will be taken

into account before a decision is made.

The developer of the site and their contractors have been made fully aware

of their responsibilities in terms of the planning conditions in question

and the potential consequences of failing to comply with them.
